(No. 112.) Sir,
Vienna, August 21, 1908. WITH reference to your despatch No. 50 of the 29th April last, I have the honour to transmit herewith translation of a note which I have received from the Ministry of Foreign Affairs regarding the protection of foreign trade-marks in China. The note states that no definite reply to the inquiries which I made can as yet be returned, as the negotiations between the Austrian and Hungarian Ministers concerned are still incomplete. It is, however, expected that these negotiations will shortly be concluded, and I am promised further information as soon as may be possible.

August 18, 1908. WITH reference to Sir E. Goschen's note of the 9th May last, relative to the conclusion of an Agreement between Great Britain and Austria-Hungary with a view to the mutual protection of their trade-marks in China through the Consular Courts, the Undersigned has the honour to inform his Excellency that, according to information received from the two competent Ministries in Austria and in Hungary, the negotiations proceeding with a view to the introduction into the Consular Courts of the necessary laws for the protection of trade-marks and for the extension of the jurisdiction of these Courts to cases of infringements of these laws are not yet concluded,
Consequently the necessary premises are still wanting for the completion of an understanding with foreign States on the part of Austria-Hungary which will assure reciprocal Consular protection against infringements by Austro-Hungarian subjects of the trade-mark rights of the subjects of the States in question.
The conclusion of these negotiations between the Austrian and Hungarian Governments is, however, shortly expected, and the Undersigned will not fail to return to the subject as soon as possible.
